Copyright/Print Release

Dear Clients,

I hope this message finds you well. I understand there might be some confusion regarding the terms "print rights" and "copyrights" in photography, so I'd like to take a moment to clarify the differences to ensure we are on the same page and informed regarding photography services.

Firstly, when we talk about “copyrights,” we are referring to the legal rights that I, as the photographer, possess over the produced images. Holding the copyright means I have exclusive control over how these images are reproduced, distributed, and displayed. Copyright ownership allows me to protect my work from unauthorized use and use for promotion of my business.

On the other hand, “print rights” is a term often used to describe the permission that you, as the client, receive to reproduce the images for personal use. When I grant you print rights, you have the liberty to print copies of the images for yourself and your loved ones, create albums, or even display the photos in your home or office. However, it's crucial to understand that print rights do not permit you to use the images for commercial purposes or to distribute them in ways that could generate income.

In simpler terms, while I retain the copyrights to the photographs, providing you with print rights means you are free to enjoy the images for personal, non-commercial use without infringing on my ownership rights as the photographer.

Should you require the images for commercial purposes or broader distribution, we would need to discuss an additional agreement or licensing arrangement to legally and fairly accommodate such needs.

When you purchase or are gifted digital files from me (noncommercial use), you will be presented with a print release and special instructions for handling those files.

This release gives you permission to:

• Order prints and products for personal use sizes 8x10 and smaller. Larger size prints have to be purchased through the artist to ensure quality control.

• Share images on the web via email and social media.

• Archive

The release does NOT give you permission to:

• Edit or modify the images in any way.

• Sell the images.

• Submit the images into contests or use for commercial advertisement without permission from the photographer.

The photographer is not responsible for the outcome of prints and products that you order with the digital files provided. Each file is carefully color corrected on a calibrated monitor matched to my professional print lab. I cannot be responsible for other vendors and their calibration or printing processes. For this reason, I highly recommend printing through certain reputable labs (which I will recommend for you at the time of purchase or access). We ask that you do not print on home printers or 1-hour quick labs such as Walmart/Walgreens/CVS as they are not able to produce the type of quality image your memories or investments deserve.
